Gform Terms of Use

These Terms of Use ("Terms") govern your use of Gform (the "App"), provided by Zoomob Limited ("Zoomob", "we", "us", or "our"). By downloading, accessing, or using Gform, you agree to these Terms. If you do not agree, do not use the App.

1. About Gform

Gform is an independent client application that allows users to access and manage Google Forms and related Google Drive and Google Sheets content. Gform is not a Google product and is not endorsed by or affiliated with Google LLC. Google Forms, Google Drive, Google Sheets, and Google are trademarks of Google LLC.

2. Eligibility and Google Account

You must be legally permitted to use the App and able to enter into these Terms. You need a valid Google Account and must authorize the Google permissions required for the features you choose to use. You are responsible for maintaining the security of your device and Google Account and for all activity performed through them.

Your use of Google services remains subject to Google's applicable terms, policies, quotas, and availability. You may revoke Gform's authorization through your Google Account, but doing so will disable features that require Google access.

3. Licence

Subject to these Terms, Zoomob grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Gform for lawful purposes. No ownership rights are transferred to you. You may not copy, modify, distribute, sell, lease, reverse engineer, bypass security controls, or create derivative works from the App except where applicable law expressly permits it.

4. Your content and instructions

You retain ownership of content in your Google Account. You authorize Gform to access and process that content only as needed to perform actions you request. Depending on the feature used, Gform can create, read, edit, share, link, upload to, or move Google Forms and related Drive or Sheets content to trash.

You are responsible for reviewing information before saving or submitting changes. Actions confirmed in the App may immediately affect content in your Google Account. You are responsible for maintaining any backups you require and for ensuring that you have the rights and permissions necessary for content you upload, collect, or share.

5. Privacy

Our collection and use of information is described in the Gform Privacy Policy. By using the App, you acknowledge that Google also processes information under Google's own terms and privacy policy.

6. Acceptable use

You must not use Gform to:

  • violate any law, regulation, court order, or third-party right;
  • collect, upload, disclose, or process personal information without an appropriate legal basis or required consent;
  • create deceptive, fraudulent, abusive, harassing, discriminatory, or unlawful forms or content;
  • send spam, phishing requests, malware, or unsolicited communications;
  • access another person's account or data without authorization;
  • interfere with, overload, probe, or circumvent the App, Google services, security measures, or usage limits; or
  • use data obtained through the App for surveillance, advertising profiles, credit decisions, or any purpose prohibited by Google API policies.

7. Third-party services

Gform depends on Google Sign-In and Google APIs. Google may change, restrict, suspend, or discontinue its services, permissions, or APIs at any time. We do not control Google services and are not responsible for their content, policies, outages, account restrictions, data loss, or other acts or omissions. Links to third-party services are provided for convenience and do not constitute endorsement.

8. Availability and updates

We may update, change, suspend, or discontinue all or part of Gform to maintain security, comply with law or platform requirements, address technical issues, or improve the App. We do not guarantee that every feature will always be available or compatible with every device, operating system, Google account type, or Google service configuration.

9. Disclaimers

To the maximum extent permitted by law, Gform is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, Zoomob and its directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, content, revenue, profits, goodwill, or business opportunity arising from or related to the App or third-party services. Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law.

11. Indemnity

To the extent permitted by law, you agree to indemnify Zoomob against claims, losses, and reasonable costs arising from your unlawful use of the App, your content, or your violation of these Terms or another person's rights.

12. Suspension and termination

You may stop using Gform and revoke its Google access at any time. We may suspend or terminate access where reasonably necessary to address unlawful use, security risks, policy violations, legal requirements, or threats to the App or other users. Provisions that by their nature should survive termination will remain effective.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the effective date and provide additional notice where required. Your continued use of Gform after updated Terms take effect constitutes acceptance to the extent permitted by law.

14. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. The courts of Hong Kong will have non-exclusive jurisdiction, subject to any mandatory consumer rights or jurisdiction that applies where you live.
